General Terms and Conditions ILS and MYTUTOR (GTC)

1. Scope

1.1 These General Terms and Conditions (“GTC”) apply to all offers, services, courses, exams, consultations, private lessons, corporate courses, online courses, and other services provided by ILS and MYTUTOR.

1.2 These Terms and Conditions form an integral part of all contracts between ILS / MYTUTOR and its customers.

1.3 Any terms and conditions of the client that differ from these shall apply only if ILS / MYTUTOR has expressly accepted them in writing.

2. Conclusion of the Contract and Acceptance of the Terms and Conditions

2.1 A contract is formed as soon as a Registration, booking, appointment, or course confirmation is made in writing, electronically, verbally, or by implication and is confirmed by ILS / MYTUTOR.

2.2 Written or electronic confirmation includes, in particular, confirmations via email, text message, WhatsApp, contact form, online booking, on-site signature, social media message, payment of an invoice or deposit, as well as attendance at classes.

2.3 Any written or electronic confirmation of a course, lesson, exam, or other service shall be deemed a binding contract for the sale of goods or the provision of services within the meaning of Art. 1 et seq. of the Swiss Code of Obligations.

2.4 By making their first Registration, booking, or confirmation, the customer declares that they have read, understood, and accepted the currently valid Terms and Conditions.

2.5 Once consent to these Terms and Conditions has been given, it remains in effect permanently and applies to all future bookings, registrations, scheduling of appointments, course extensions, follow-up courses, exams, and services provided by ILS / MYTUTOR.

2.6 Consent does not need to be given again for subsequent bookings. If another Registration course confirmation is made—particularly via email—the Terms and Conditions are automatically deemed to have been accepted again.

2.7 ILS / MYTUTOR reserves the right to amend these Terms and Conditions at any time. For new bookings, the Terms and Conditions in effect at the time of booking shall apply.

3. Prices and Payment Terms

3.1 The prices published at the time or those agreed upon individually shall apply.

3.2 Unless otherwise agreed, invoices are payable net within 10 days.

3.3 If the customer fails to make payment on time, the customer shall be in default without further notice.

3.4 If the customer defaults on payment, ILS / MYTUTOR is entitled to charge default interest at a rate of 5% per annum in accordance with Art. 104 of the Swiss Code of Obligations. In addition, the following reminder fees may be charged as a lump-sum compensation for administrative expenses if payment is not made despite the due date having passed:

  1. Payment reminder: free of charge
  2. Reminder: CHF
  3. and final reminder: an additional CHF , for a total of CHF in late fees

If the final reminder goes unheeded, ILS / MYTUTOR is entitled to refer the claim to a debt collection or legal services firm or to take legal action. ILS / MYTUTOR is also entitled to suspend all services until all outstanding claims have been paid in full.

3.5 If a reminder is unsuccessful, the claim may be transferred to a debt collection or legal services firm. Any additional costs incurred as a result shall be borne by the customer, to the extent permitted by law.

3.6 Payments will first be applied to collection fees, late payment interest, and collection costs, and only then to the principal amount.

3.7 For registrations from abroad and for customers residing outside Switzerland, ILS / MYTUTOR may require full payment of the total amount in advance. Registration definitively confirmed only after full payment has been received. If payment is not received by the due date, ILS / MYTUTOR is entitled to cancel the Registration further notice.

4. Private lessons and corporate courses

4.1 Agreed dates are binding.

4.2 Any rescheduling or cancellation must be notified in writing at least 24 hours before the agreed appointment.

4.3 If the cancellation is made late or the client fails to show up, the full cost of the lesson will be charged.

4.4 Valid excuses are limited exclusively to illness or accident, upon presentation of a medical certificate, as well as the death of an immediate family member, exclusively upon presentation of an official death certificate or an equivalent official confirmation, and exclusively for the day of the funeral or memorial service.

4.5 In such cases, ILS / MYTUTOR may, at its sole discretion, issue a credit or schedule an alternative date. There is no entitlement to a cash refund.

5. Group Classes

5.1 Customer absences do not entitle the customer to a refund or a price reduction.

5.2 In exceptional cases as described in Section 4.4, ILS / MYTUTOR may issue a credit.

5.3 Credit notes are personal, non-transferable, and must be redeemed within 12 months.

6. Withdrawal, Cancellation, and Course Termination

6.1 You may cancel your registration for group courses free of charge up to 7 calendar days before the course begins.

6.2 If cancellation occurs after this date, the full course fee remains due.

6.3 Under no circumstances will amounts already paid be refunded or paid out in cash. There is also no entitlement to a credit. ILS / MYTUTOR may grant a credit at its discretion and without acknowledging any legal obligation.

6.4 For private lessons, corporate courses, exams, and individually booked services, cancellations are not permitted after the contract has been concluded.

6.5 Withdrawal from a course after it has begun—for whatever reason—does not entitle the student to a refund.

6.6 Unused private lessons, individual sessions, and credits from private lessons expire no later than 3 years after the date of purchase. The agreed-upon price remains fully payable in all cases, regardless of actual usage. Refunds, cash payments, offsets, or reductions are excluded. For group courses, there is no entitlement to make up missed lessons, transfer them, or redeem them at a later date, unless otherwise expressly provided for in these Terms and Conditions.

7. Teachers and Class Organization

7.1 ILS / MYTUTOR reserves the right to replace instructors at any time, assign substitutes, arrange for team teaching, or make organizational adjustments to the classes.

7.2 There is no entitlement to a specific teacher.

7.3 ILS / MYTUTOR reserves the right to combine, reschedule, switch to online instruction, or cancel courses if such action is objectively justified or organizationally necessary.

8. Online Classes

8.1 The same rules apply to online classes as to in-person classes.

8.2 Technical issues on the customer’s end—particularly a lack of internet connection, faulty equipment, or software problems—are the customer’s responsibility and do not entitle the customer to a refund.

8.3 ILS / MYTUTOR shall not be liable for interruptions, outages, or technical malfunctions of third-party platforms.

9. Exams

9.1 For all exams offered or arranged by ILS / MYTUTOR—including, in particular, telc, fide, SDS, ÖSD, and Oxford exams, as well as other language, subject-specific, or certification exams—the applicable exam regulations, registration requirements, deadlines, and guidelines of the respective exam organization also apply.

9.2 By Registration , customers expressly Registration that they have read, understood, and accepted the terms and conditions of the respective examination organization.

9.3 Exam registrations are binding. Cancellations or rescheduling are only permitted within the applicable deadlines and under the conditions set by the relevant exam organization. Once these deadlines have passed, the full exam fee remains due.

9.4 Examination fees remain due in all cases, particularly in the following instances:

  • Failure of the exam
  • Delayed Publication
  • failure to appear
  • incomplete documents
  • missing identification documents
  • Exclusion from the exam for organizational or procedural reasons

9.5 Anyone who arrives late on the day of the exam, fails to present the required identification documents, or has not paid the exam fee in full may be barred from taking the exam. In such cases, the exam fee remains due in full.

9.6 There is no right to a refund, retake, review, re-evaluation, or discussion of the exam, unless expressly provided for by the exam administration.

9.7 ILS / MYTUTOR assumes no liability for decisions, evaluations, exam results, organizational changes, exam cancellations, or other measures taken by the respective exam administration.

10. Trial Lesson

10.1 ILS / MYTUTOR may offer a maximum of two trial lessons per person. A trial lesson consists of no more than two sessions, or 90 minutes.

10.2 The trial lesson is free of charge only if no booking is made afterward. If a Registration is made afterward, the cost of the trial lesson will be billed separately or applied toward the cost of the booked service.

10.3 After the second trial lesson, there is no entitlement to further trial lessons.

10.4 If the client repeatedly fails to attend the agreed trial lesson without providing a valid reason, ILS / MYTUTOR is entitled to charge a service fee of CHF .

11. SVEB Certificate Courses

11.1 Withdrawals from SVEB courses are free of charge only if made no later than 12 calendar days before the course begins. After that, the full course fee remains due.

11.2 For all SVEB modules, attendance is required for at least 80% of the contact hours.

11.3 Arriving more than 45 minutes late or leaving class early is considered a partial absence and will be deducted from the attendance time accordingly.

11.4 If attendance falls below the required minimum, the module is considered failed and must be retaken in its entirety at the student’s expense.

11.5 In the event of illness or other compelling reasons beyond the student’s control, ILS may, at its discretion and upon presentation of appropriate documentation, allow the student to make up individual class days in a different class group.

11.6 If the practical demonstration is not passed, it may be retaken once in another SVEB course for a fee. The fee for the retake is CHF .

11.7 Appeals against decisions regarding failure may be submitted in writing, with supporting reasons, to the program director within 30 days of notification. After that, the provisions of the SVEB apply.

12. Teaching Materials and Placement

12.1 Teaching materials, exam materials, books, and other course materials are not included in the course price, unless otherwise expressly agreed in writing.

12.2 For online courses, customers are responsible for obtaining the necessary course materials themselves.

12.3 If the customer has prior knowledge of the subject matter, they are required to take Registration placement test or attend a consultation before Registration . ILS / MYTUTOR assumes no liability for incorrect bookings resulting from inaccurate or incomplete information provided by the customer.

13. International Participants and Visas

13.1 Participants residing abroad must pay the full course fee no later than 30 calendar days before the course begins.

13.2 If payment is not made on time, ILS / MYTUTOR is entitled to cancel the Registration further notice.

13.3 If a visa application is denied, a cancellation may be requested upon presentation of the official denial notice no later than 7 calendar days before the start of the course. In this case, a flat-rate processing fee of CHF remains due. No further refunds will be issued.

14. Special Circumstances and Regulatory Measures

14.1 If classes must be adjusted or rescheduled due to official orders, force majeure, epidemics, pandemics, strikes, technical malfunctions, or other circumstances beyond the control of ILS / MYTUTOR, ILS / MYTUTOR is entitled to replace in-person classes with online classes.

14.2 In such cases, there is no entitlement to a refund, a price reduction, compensation, or termination of the contract.

14.3 If the client is unable or unwilling to participate in the online classes offered, the full fee remains due.

15. Non-solicitation clause

15.1 Customers agree not to hire any ILS / MYTUTOR instructors, either directly or indirectly, or to engage them outside of ILS / MYTUTOR during the term of the agreement and for a period of 12 months thereafter.

15.2 In the event of a breach of this provision, the client shall be liable to pay a contractual penalty of CHF , CHF per affected teacher. We reserve the right to claim higher damages.

16. Gift Certificates and Store Credit

16.1 Vouchers, credit notes, and remaining balances are non-transferable and cannot be redeemed for cash.

16.2 Vouchers expire no later than 12 months after the date of issue.

16.3 Lessons or course credits that have already been paid for expire no later than 3 years after the date of purchase.

17. Means of communication

17.1 The customer agrees that communication may take place via email, telephone, WhatsApp, text message, or other electronic means of communication.

17.2 Notices sent to the last known email address or phone number shall be deemed to have been validly served.

17.3 Automatically generated emails, booking confirmations, invoices, and reminders are considered legally valid.

18. Data Protection

18.1 ILS / MYTUTOR processes personal data in accordance with the Swiss Data Protection Act (DSG).

18.2 The customer agrees that their data may be processed and stored for the purposes of contract fulfillment, accounting, course administration, exam registration, communication, and marketing.

18.3 Information will only be disclosed to third parties to the extent necessary to fulfill the contract or required by law.

19. Photographs, audio recordings, and video surveillance

19.1 ILS / MYTUTOR may make audio, video, and photographic recordings during courses, exams, and events for organizational, quality assurance, or security purposes.

19.2 Cameras may be used on the premises for security reasons. Video surveillance is conducted only in designated areas and in compliance with applicable data protection laws.

19.3 Areas requiring greater privacy, particularly restrooms and changing rooms, are not monitored.

20. Liability

20.1 ILS / MYTUTOR shall be liable only for damages caused by willful misconduct or gross negligence.

20.2 Any further liability—in particular for slight negligence, indirect damages, consequential damages resulting from defects, lost profits, data loss, exam success, or learning success—is expressly excluded to the extent permitted by law.

20.3 Participation in courses and events is at your own risk.

20.4 We assume no liability for the loss, theft, or damage of personal belongings.

20.5 Parents or legal guardians are responsible for minor participants.

21. Severability Clause

If any provision of these Terms and Conditions is invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely approximates its economic purpose.

22. Governing Law and Jurisdiction

22.1 This Agreement shall be governed exclusively by the substantive laws of Switzerland, to the exclusion of conflict-of-laws principles.

22.2 The place of jurisdiction for all disputes is—to the extent permitted by law—Bern, Switzerland.

22.3 We reserve the right to invoke any mandatory statutory venues of jurisdiction.
